While Bush denied Daniel's firing was related to attendance during a phone interview with The Record, he refused to disclose the actual reason for her dismissal, claiming the information belonged to AutoZone. Bush also said he was unaware of the lawsuit.

The lawsuit alleges she was called various racial expletives not only in front of customers but also Store Supervisor Heath Savage and former co worker Ricky Martin, a commercial manager as well as a parts sales manager during Daniel's time of employment at the store.

In May 2012, Martin and Daniel engaged in a verbal altercation which soon led to a physical one. The complaint alleges Martin verbally assaulted Daniel and even made threats toward her family. After Daniel tapped Martin on the back of the head, Martin responded by throwing a partially full gas can at her.
When confronted at the Hoosick Street shop, Savage also said he was unaware of the complaint against him. He then referred all questions to Bush.
Martin was mentioned numerous times throughout the lawsuit for using several racial epithets toward Daniel and making comments such as, "don't get sassy with me sista." But along with the verbal harassment, Daniel was also subjected to physical violence at the hands of Martin, according to the complaint.
According to the lawsuit, company policy states that an employee who has accumulated 12 occurrence points for instances such as unexcused absences, can be terminated. The complaint not only claimed that Daniel had less than 12 points, but also alleged the attendance policy was unfairly enforced by Savage, who would assign more points to Daniel than her white male coworkers.

The incident was reported to District Manager Todd Bush. An investigation soon followed which led to both Martin and Daniels being fired. According to the complaint, Daniel applied for unemployment insurance benefits but her application was contested by AutoZone for allegedly violating the company's attendance policy.
The lawsuit also claimed Daniel constantly made Savage and various other supervisors aware of the harassment she suffered at the hands of other coworkers but no action was ever taken. Daniel said she had a telephone conversation with Hope Ritz from the Human Resources department at AutoZone, who told her Divisional Human Resource Manager Rich Thompson was aware of the incidents and said, "things were being done that should not have been done" and "we are still willing to help you."

The lawsuit, filed in federal court on behalf of Dawn Daniel, a black woman who worked at AutoZone store on Hoosick Street as a parts sales manager from July 2010 until she was fired in June 2012, detailed several instances in which she was allegedly discriminated against based on her race.
Daniel requested in the complaint these actions taken by the defendants be stopped as well as to be paid all earnings she would have received if not for actions taken by her supervisors. This included wages, bonuses, pension and other lost benefits.

Bush referred all questions to the Human Resources Department, which referred all questions to the Media Relations Department. A spokesperson for that department declined to comment about the situation but said the company was aware of the complaint.
