According to the lawsuit, company policy states that an employee who has accumulated 12 occurrence points for instances such as unexcused absences, can be terminated. The complaint not only claimed that Daniel had less than 12 points, but also alleged the attendance policy was unfairly enforced by Savage, who would assign more points to Daniel than her white male coworkers.

The incident was reported to District Manager Todd Bush. An investigation soon followed which led to both Martin and Daniels being fired. According to the complaint, Daniel applied for unemployment insurance benefits but her application was contested by AutoZone for allegedly violating the company's attendance policy.
